Waikuku Beach Online — Terms of Use
Last updated: 29 October 2026
1. About this website
1.1 Waikuku Beach Online (waikukubeach.co.nz, "the website") is a place for community information about Waikuku village, Waikuku Beach and the surrounding area.
1.2 The website is owned and operated by Amo Technology Ltd, a New Zealand limited company based in Waikuku Beach, North Canterbury (NZBN 9429034885536). In these terms, "we", "us" and "our" mean Amo Technology Ltd. "You" means anyone who visits or uses the website or sends us information.
1.3 The website is an independent community resource. It is not operated by, or on behalf of, Waimakariri District Council, Civil Defence, any emergency service or any business, club or group mentioned on it.
1.4 The website is an information resource only. We are not an organiser, regulator or safety authority, and we do not guarantee any service provided by others.
2. Using this website
2.1 By using the website or sending us information, you agree to these terms. If you do not agree, please do not use the website.
2.2 You do not need an account to use the website, and we do not sell anything through it.
2.3 These terms apply together with our Privacy Statement, published on the Privacy page, and any notices shown on particular pages.
3. Information and external links
3.1 We publish local information in good faith and take reasonable care to check it. However, details such as opening hours, collection days, bin colours, event dates, prices, facilities and contact numbers can change without notice, and we cannot guarantee that everything is complete, current or error-free.
3.2 Information on the website is general information only. It is not professional, legal, financial, safety or health advice. Before making plans or decisions, please check with the official provider, organiser or business.
3.3 The website links to, and may display features from, other websites and services, such as Waimakariri District Council, Metro, MainPower, Vote NZ, Weather Underground and SurfCheck NZ. These are run by others under their own terms and privacy policies. We do not control them and are not responsible for their content, availability or accuracy. A link does not mean we endorse the site or its operator.
3.4 Forecasts, timetables and other third-party information are shown or linked as provided by their source. We do not alter or verify them.
4. Third parties and your own judgement
4.1 Many things mentioned on the website are run or supplied by others. To the extent permitted by New Zealand law, neither Amo Technology Ltd nor the website is responsible for:
- the operations, services or conduct of listed businesses, clubs and community organisations;
- events, activities, facilities or services organised or operated by others;
- changes, inaccuracies or omissions in information supplied by external organisations;
- weather forecasts, surf conditions, swimming conditions or other information from third parties;
- the content, availability or accuracy of external websites; or
- decisions you make using information found on the website.
4.2 You must check relevant information with the official source or the organisation concerned, and use your own judgement, before relying on it.
4.3 This section does not remove any responsibility we have under New Zealand law for information we write or publish ourselves, or for how we handle personal information.
5. Emergencies and safety
5.1 In an emergency, call 111. For non-urgent Police matters, call 105.
5.2 This website is not an emergency, warning or alert service. It is not monitored around the clock and may not show current alerts. Always follow official advice from Civil Defence, emergency services and Waimakariri District Council.
5.3 If you are near the coast and feel a long or strong earthquake, move immediately to high ground or as far inland as you can. Do not wait for an official warning.
5.4 Information about beaches, surf, pools, weather and outdoor activities is general only. You are responsible for your own safety and for supervising children. Check conditions, signage and official advice before swimming or surfing.
6. Listings
6.1 The website may list local businesses, clubs, community groups and facilities. Listings are provided for information only.
6.2 A listing is not an endorsement, recommendation or guarantee of any business, group, product or service. Any dealings you have with a listed organisation are between you and that organisation.
6.3 We publish listing details supplied by, or checked with, the organisation where possible. Organisations are responsible for telling us when their details change.
6.4 Listed organisations can ask us at any time to correct, update or remove their listing. We may decline, change or remove any listing at our discretion.
6.5 Names, logos and trade marks belong to their owners. Showing them on the website does not mean the owner sponsors, endorses or is connected with the website.
7. Events
7.1 Events are listed for community information. Unless we say otherwise, we do not organise, run, insure or supervise them.
7.2 Event organisers are responsible for their events, including dates, venues, safety, permits, tickets, cancellations and refunds. Please check details with the organiser before attending.
7.3 By sending us an event, you confirm you are the organiser or have the organiser's permission, and that the details are accurate.
8. Contributions
8.1 We welcome local information, photographs, videos, stories, artwork, event details and corrections ("contributions"), sent by email to hello@waikukubeach.co.nz.
8.2 By sending a contribution, you confirm that:
- you created it, or you have the owner's permission to share it with us for publication;
- every identifiable adult shown or named in it has been copied into your email, or you have told us how to contact them for permission (see section 9);
- for any identifiable child under 18 shown in it, their parent or legal guardian has been copied into your email, or you have told us how to contact them (see section 9);
- it is accurate to the best of your knowledge;
- it does not include anyone's private or sensitive information without their consent; and
- publishing it will not break any law or anyone else's rights.
8.3 You keep the copyright in your contribution. By sending it, you give Amo Technology Ltd non-exclusive permission to publish it on the website, and to resize, crop, format, shorten or lightly edit it for clarity or space. We will not change its meaning without asking you.
8.4 We will credit you, or the person you name as the creator, unless you ask us not to. Please tell us how you would like to be credited.
8.5 Website only. Photographs and videos sent to us are for publication on the website only. We will not republish, share or post them on any social media account associated with the website or with Amo Technology Ltd. Permission to publish on the website is not permission to publish on social media. The website may link to external social media pages, but that does not authorise anyone to reuse photographs or videos sent to us.
8.6 You can ask us to remove your contribution at any time. Once we have verified the request, we will remove it from the website as soon as reasonably practicable, and no later than 10 working days. We cannot control copies others may already have made, and we may keep a record of the request.
8.7 We do not pay for contributions, and sending a contribution does not create any employment, partnership or agency relationship.
8.8 You remain responsible for having the rights and permissions needed to send us your contribution. Our review of a contribution does not transfer that responsibility to us.
9. People, children and cultural material
9.1 Photographs and videos of people are only published with each person's permission. This applies to any adult who can be identified in a photograph or video, or named in a story.
9.2 Copy them in. When you send a photograph or video showing identifiable adults, please copy each of them (cc) into your email so they can confirm their permission directly with us. If you cannot copy someone in, tell us who they are and how to contact them, and we will ask for their permission before publishing.
9.3 Nothing is published until permission is confirmed. We will not publish the photograph or video until every identifiable adult has confirmed their permission in writing. If someone does not agree or cannot be reached, we will crop or blur them out, or not publish it.
9.4 Children. A photograph or video showing an identifiable child under 18 will only be published on the website after we have received prior written consent from the child's parent or legal guardian and verified it. Please copy the parent or legal guardian into your email, or tell us how to contact them. Permission from a school, club or other organisation is not enough on its own. If we cannot tell whether someone is under 18, we will treat them as a child.
9.5 Verifying consent. We take reasonable steps to confirm that the person giving consent is the child's parent or legal guardian, for example by contacting them directly. If we cannot verify consent, we will not publish the photograph or video. Consent covers publication on the website only.
9.6 No children on social media. We will not publish photographs or videos showing identifiable children on any social media account associated with the website or with Amo Technology Ltd.
9.7 Removal. Anyone shown in a photograph or video on the website, or the parent or legal guardian of a child shown, can ask us to remove it, whether or not they sent it. Once we have verified the request, we will remove it as soon as reasonably practicable, and no later than 10 working days. A parent or legal guardian can withdraw consent at any time in the same way.
9.8 We respect Ngāi Tūāhuriri as mana whenua. We take care with material about Māori history, places, taonga and tikanga, and will seek appropriate guidance or permission before publishing it. We may decline or remove such material where that is the right thing to do.
9.9 The permissions you confirm help us decide what to publish. They do not replace our own responsibilities: we remain responsible, under the Privacy Act 2020 and other New Zealand law, for the decisions we make about what we publish.
10. Editorial decisions
10.1 Everything is reviewed before it is published. Sending a contribution, event or listing does not mean it will be published.
10.2 We decide what appears on the website. We may decline, delay, edit (as described in 8.3) or remove any contribution, event or listing at any time, and we do not have to give a reason.
10.3 The website does not host public comments, forums or discussions. We aim to keep it factual, local and non-political. We do not publish content that promotes political parties or candidates, or that is commercial advertising disguised as community information. Neutral election information from official sources is not affected.
10.4 Views expressed in contributed stories are those of the contributor, not of Amo Technology Ltd.
11. Copyright and reuse
11.1 Unless stated otherwise, the website's design, text and original content belong to Amo Technology Ltd. Photographs, artwork, logos and contributions belong to their creators or owners and are used with permission.
11.2 You may view pages and share links to them for personal, non-commercial use. Please do not copy, republish or sell artwork or text from the website without permission from us or the owner named on the content.
11.3 Photograph copyright and use. Photographs displayed on this website are published with permission from their respective owners. They must not be copied, downloaded, reproduced, distributed, republished or shared on social media without the prior permission of the copyright owner. Permission to display a photograph on the Waikuku Beach Online website does not grant visitors permission to reuse it elsewhere.
11.4 “Waikuku Beach” is a geographical place name and is not claimed as the exclusive property of Waikuku Beach Online. However, the website’s original logo, branding and design may not be reproduced or used in a way that falsely suggests an association with, or endorsement by, Waikuku Beach Online.
12. Corrections, complaints and removal requests
12.1 If you think something on the website is wrong, out of date, unfair, or uses your work, image or information without permission, please email hello@waikukubeach.co.nz with:
- the page or item concerned;
- what the problem is; and
- how we can contact you.
12.2 We will acknowledge your request within 5 working days and correct, update or remove the content where appropriate. Where a request concerns safety, children or personal information, we may take the content down while we look into it.
12.3 If you are not satisfied with our response, you can ask us to review it. Privacy complaints can also go to the Office of the Privacy Commissioner (see section 9 of our Privacy Statement).
13. Acceptable use
13.1 When using the website or sending us anything, you must not:
- send false, misleading, defamatory, offensive or harassing material;
- send material that harms, threatens or embarrasses another person, or shares their private information without consent;
- send material you do not have the right to share;
- pretend to be someone else, or misrepresent your connection with a group or business;
- send spam, advertising, viruses or harmful code; or
- try to interfere with, copy at scale, or gain unauthorised access to the website or its systems.
13.2 We may ignore, delete or block messages from anyone who does not follow these terms, and may report unlawful material to the appropriate authorities.
14. Liability
14.1 The website is provided "as is" and "as available". We do not promise that it will always be available, accurate, or without errors or viruses.
14.2 To the extent permitted by New Zealand law, Amo Technology Ltd, its directors and staff are not liable for any loss, damage, cost or injury arising from:
- the matters listed in section 4;
- any dealings with a listed business, group or event organiser;
- the website being unavailable; or
- content sent to us by others.
14.3 Nothing in these terms excludes or limits any responsibility that cannot be excluded or limited under New Zealand law. This includes rights and obligations under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 (where they apply), and our obligations under the Privacy Act 2020.
14.4 These terms set out the limits of our responsibility as far as the law allows. They do not mean we accept no legal responsibility for our own actions.
14.5 Your responsibility for contributions. If you send us material that breaks section 8, 9 or 13 (for example, a photograph you did not have permission to share), you are responsible for that, and you agree to cover reasonable costs and claims we face as a result.
15. General
15.1 We may change, pause or close the website, or any part of it, at any time.
15.2 We may update these terms from time to time. The current version, with its date, will always be on this page. Continuing to use the website after a change means you accept the updated terms.
15.3 If any part of these terms cannot be enforced, the rest still applies.
15.4 If we do not enforce a term straight away, we can still enforce it later.
15.5 These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
